theft or burglary offense PLUS a prison sentence of one year or more; various federal criminal offenses (including document fraud, including some analogous state offenses); owning, controlling, managing, or supervising a prostitution business; commercial bribery; counterfeiting; forgery; trafficking in vehicles with altered VIN numbers PLUS a prison sentence of one year; and fraud, deceit, or tax evasion offenses PLUS a victim loss in excess of $10,000.

Criminal Dispositions Leading to Exclusion from the U.S.

The following dispositions could result in exclusion from the country:

1) Conviction or admitted commission of any controlled substance offense, or mere government knowledge (or mere reason to believe) the individual is an illicit trafficker in a controlled substance.

2) Conviction or admitted commission of a crime involving "moral turpitude," (subject to certain exceptions).

3) Conviction of two or more offenses of any type plus aggregate sentence of imprisonment of at least five (5) years.

4) Prostitution and commercialized vice.

Note: the INS may declare your client excludable from the U.S. even though his/her conviction may not have been sufficient to trigger deportation.

Many noncitizens return to their countries of origin for the holidays only to find they are excludable when they try to return.

Note: no conviction is required to find your client "excludable."

Also recognize that deportation is a civil proceeding. The "ex post facto" doctrine does not apply to deportation hearings.

Twenty years from now, Congress can pass laws which make today’s minor unforeseen criminal convictions the basis for deportation.
