| Clifford Girard - Minding Your P's and Q's - The Battle of the Forms |
PHX (CAAP) - Phoenix attorney Clifford Girard is busy minding your Ps and Qs.

Girard stated the PCL practices completely ignore Arizona Department of Health Services Regulations (See, R9-14-404(A)(2). According to Girard, the ADHS regulations contemplate use of an "evidence card," upon which the IR5000 machine prints. Without the "evidence card" there is no tangible evidence that the highly touted internal safeguards of the IR5000 are working properly. Girard asserts the decision to eliminate the "evidence cards" was intentionally designed to eliminate a defendants ability to verify the accuracy and history of a particular machine. Elimination of the "evidence cards" destroys a persons ability to check that the IR5000 is working properly, Girard said. The "evidence card" is a crucial document that allows a defendant to investigate whether the results on the card agree with the results stored in ADAMS (a computer database), he said. The card results can also be cross-checked with the LED display results on the IR5000. The display results are written on Exhibit P by the criminalist, according to Girard. |
New Attorneys Awarded
Contracts PHX (CAAP) - Our office recently announced the arrival of three new lawyers, Chris McBride, Charles McNulty, and Treasure Van Dreumel. All are experienced trial lawyers. Please welcome them to the Phoenix Municipal Court. Chris McBride recently opened his own office after working with Weingart & Associates, and hes a former assistant director of the Phoenix Contract Attorneys Office. Chris is a regular speaker at DUI seminars in Arizona. Charles McNulty is a solo practitioner, and he is a former Maricopa County Public Defender. He has practiced law since 1981. Mr. McNulty has also tried capital murder cases and other major felonies. Treasure Van Dreumel is the most recent arrival. She is a solo practitioner with death penalty and major felony trial experience. Ms. Van Dreumel also once worked for the Maricopa County Public Defenders Office before opening her own office.
